Acceptance of Terms
By downloading, installing, or using Awakened AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Ascend Labs LLC ("we," "us," or "our").
Eligibility
You must be at least 13 years of age to use Awakened AI. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have parental or guardian consent to use the App.
Description of Service
Awakened AI is an AI-powered iOS application that provides conversational AI responses across six distinct modes. The App includes features such as web search, YouTube transcript analysis, image analysis, and daily curated content. Some features require a paid subscription ("Awakened" tier).
AI-Generated Content Disclaimer
All responses generated by Awakened AI are produced by artificial intelligence and are for informational and entertainment purposes only. You acknowledge that:
- AI responses may be inaccurate, incomplete, or misleading.
- Content is designed to provoke thought, not replace professional judgment.
- Nothing in the App constitutes medical, legal, financial, psychological, or any other professional advice.
- You should not make important decisions based solely on AI-generated content.
- Alternative perspectives presented by the App do not represent the views of Ascend Labs LLC.
User Accounts
You may use Awakened AI as a guest or create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the security of your account and for all activity that occurs under your account. You must notify us immediately of any unauthorized access.
Subscriptions and Payments
- Awakened AI offers a free tier and a premium "Awakened" subscription.
- Subscriptions are billed through the Apple App Store and governed by Apple's payment terms.
- A 3-day free trial is available for new subscribers. Trial automatically converts to a paid subscription unless cancelled before the trial period ends.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Refunds are handled by Apple in accordance with their refund policy.
- We reserve the right to modify subscription pricing with reasonable notice.
Prohibited Uses
You agree not to use Awakened AI to:
- Generate content that is illegal, harmful, threatening, abusive, or harassing.
- Violate any applicable laws or regulations.
- Impersonate any person or entity.
- Attempt to reverse engineer, hack, or compromise the App or its backend systems.
- Use automated means to access the App beyond normal usage.
- Generate or distribute spam, malware, or malicious content.
- Attempt to circumvent usage limits or rate limits.
- Use the App for any commercial purpose without our express written consent.
Intellectual Property
The App, including its design, code, branding, and content (excluding your conversation inputs), is owned by Ascend Labs LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
You retain ownership of content you input into the App. By using the App, you grant us a limited license to process your inputs for the sole purpose of generating AI responses.
Limitation of Liability
To the maximum extent permitted by law, Ascend Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to reliance on AI-generated content, loss of data, or interruption of service.
Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
Disclaimer of Warranties
The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI responses will be accurate or appropriate for your purposes.
Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for violations of these Terms or for any other reason at our discretion. You may stop using the App and delete your account at any time.
Governing Law
These Terms shall be governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the applicable courts.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
